These Terms of Service constitute a legal agreement. By using DreamStay Hotels, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.
1. Acceptance of Terms
By accessing or using dreamstayhotels.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Maryam Trading and Consulting ("DreamStay Hotels", "we", "us", "our").
If you do not agree to these Terms, you must not use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
These Terms apply to all visitors, registered users, and anyone who accesses or uses the Platform, whether for personal (B2C) or business (B2B) purposes.
2. Description of Services
DreamStay Hotels is an Online Travel Agency (OTA) that provides hotel search, booking, and management services. We act as an intermediary between travellers and hotel suppliers. We do not own or operate any hotels.
Hotel rates and availability are sourced from RateHawk (ETG APIv3), a global hotel wholesale supplier network. Rates are subject to change until a booking is confirmed through the prebook process.
We offer two service tiers:
B2C (Business to Consumer) — Individual travellers booking hotels for personal travel via dreamstayhotels.com.
B2B (Business to Business) — Travel agencies accessing DreamStay's hotel inventory and booking tools to service their clients. B2B access is subject to a separate agreement with DreamStay.
3. User Accounts
To make a booking on DreamStay, you must create an account. By creating an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Keep your password confidential and not share it with others
- Notify us immediately at support@dreamstayhotels.com if you suspect unauthorised access to your account
- Accept responsibility for all activities that occur under your account
You must be at least 18 years of age to create an account and make bookings on DreamStay. By creating an account, you confirm that you are 18 or older.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.
4. Bookings and Reservations
When you make a booking through DreamStay, you enter into a contract with the hotel property through our supplier network. DreamStay acts as your agent in facilitating this booking.
Booking confirmation
A booking is confirmed only after:
(a) the prebook step verifies rate and availability with our supplier,
(b) payment is successfully processed by Stripe, and
(c) the supplier confirms the booking via our booking system.
You will receive a confirmation email with your booking details once confirmed.
Accuracy of information
You are responsible for ensuring all booking details are accurate, including guest names, dates, number of guests, and contact information. DreamStay is not liable for errors resulting from inaccurate information provided by the user.
Hotel policies
Each hotel operates under its own policies regarding check-in times, check-out times, age restrictions, pet policies, and additional charges. DreamStay displays available policy information but is not responsible for hotel-specific policies not disclosed by the supplier.
Rate guarantee
Rates are confirmed at the time of prebook. The rate displayed at checkout is the rate you will be charged. If a rate changes between search and prebook (rare), you will be notified before payment is taken.
5. Pricing and Fees
All prices displayed on DreamStay are inclusive of our service markup. We do not charge booking fees or hidden charges beyond the displayed total price.
Taxes
Displayed prices include applicable taxes where required by the hotel supplier. Some hotels may charge local city taxes, resort fees, or tourist taxes directly at the property — these will be indicated where disclosed by the supplier.
Currency
All prices are displayed and charged in United States Dollars (USD) unless otherwise stated. If your payment card is in a different currency, your bank or card issuer will apply their exchange rate.
Service markup
DreamStay applies a service markup to wholesale hotel rates obtained from our supplier. This markup is already included in the displayed price — you are never charged separately for our service.
B2B pricing
Travel agencies using the DreamStay B2B platform are subject to separate agreed pricing, including wholesale rates and any applicable platform fees as per their B2B agreement with DreamStay.
6. Payments
All payments are processed by Stripe, Inc. By making a payment on DreamStay, you also agree to Stripe's Terms of Service available at stripe.com/legal.
Your card is charged at the time of booking confirmation. DreamStay does not store your full card details — this information is held securely by Stripe under PCI DSS Level 1 standards.
Failed payments
If your payment is declined, your booking will not be confirmed. You may retry with a different payment method. DreamStay is not responsible for any bank charges resulting from failed or declined transactions.
Fraud prevention
We reserve the right to cancel any booking where we suspect fraudulent activity. In such cases, a full refund will be issued to the original payment method.
7. Cancellations and Refunds
Cancellation policies vary by hotel and rate type and are displayed on the hotel detail page before you book and on your booking confirmation.
Free cancellation
Bookings with free cancellation can be cancelled before the specified deadline at no charge. Refunds are processed within 3–5 business days and appear on your statement within 5–10 business days depending on your bank.
Non-refundable rates
Non-refundable bookings cannot be refunded under any circumstances once confirmed. These are clearly marked before you complete your booking.
Partial refund rates
Some rates allow cancellation with a partial refund. The penalty amount is displayed in the rate's cancellation policy before booking.
How to cancel
Cancellations must be requested through your DreamStay account dashboard under 'My Trips'. Cancellation requests submitted via email cannot be guaranteed to be processed in time to meet cancellation deadlines.
Hotel-initiated cancellations
In the rare event that a hotel cancels your confirmed booking, DreamStay will notify you immediately and issue a full refund. We will make reasonable efforts to find alternative accommodation.
DreamStay does not accept responsibility for costs incurred (travel, other accommodation, etc.) as a result of a hotel-initiated cancellation.
8. User Conduct
By using DreamStay, you agree not to:
- Make fraudulent, speculative, or false bookings
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Scrape, copy, or redistribute content from the Platform without permission
- Use automated tools, bots, or scripts to access the Platform
- Impersonate any person or entity
- Post false or misleading reviews or information
- Interfere with the normal operation of the Platform
Violation of these conduct standards may result in immediate account termination and, where appropriate, referral to law enforcement.
9. Intellectual Property
All content on dreamstayhotels.com including text, graphics, logos, icons, images, and software is the property of Maryam Trading and Consulting or its content suppliers and is protected by Canadian and international copyright law.
You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our express written permission.
Hotel images and descriptions are provided by our hotel supplier (RateHawk/ETG) and are used under licence. These remain the property of their respective owners.
10. Limitation of Liability
DreamStay acts as an intermediary between travellers and hotel suppliers. To the maximum extent permitted by applicable law:
DreamStay is not liable for:
- The quality, safety, or condition of any hotel property
- Actions or omissions of hotel staff or management
- Losses arising from hotel closures, overbooking, or property changes
- Force majeure events including natural disasters, pandemics, or government actions
- Indirect, incidental, or consequential damages arising from use of the Platform
- Loss of profits, data, or business opportunities
Our total liability to you in connection with any booking shall not exceed the total amount paid by you for that booking.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, to the extent such exclusion is not permitted by law.
11. Third-Party Services
DreamStay integrates with third-party services to operate the Platform, including:
- RateHawk (ETG) — hotel inventory and booking fulfilment
- Stripe — payment processing
- Resend — transactional email delivery
- Mapbox — location search and geocoding
Use of these services is also subject to their respective terms and privacy policies. DreamStay is not responsible for the availability, accuracy, or terms of third-party services.
Links on the Platform to third-party websites are provided for convenience only. DreamStay does not endorse and is not responsible for the content of linked third-party sites.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
Any dispute arising from or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
